General Working Agreement

This document defines the terms and conditions of our working association. All services that Enhanz (hereafter referred to as “Enhanz” or “we” or “us”) may be contracted to produce or provide for you (hereafter referred to as “you” or “the client”) will be subject to the following:

At Enhanz, our clients are at the heart of everything we do. We strive to meet your goals, exceed expectations and deliver premium results. However, it is important that we document important information to ensure we are on the same page, with a familiar understanding of our terms and conditions. 

Our contract aims to be understandable for all audiences. Within this document, we outline important information that safeguards the protection of both our clients and our organisation, now and in the future.  

What We Do

Enhanz are a professional photograph editing service, taking your content from satisfactory to striking. Through refurbishing your photographs in our transformative service, we provide you with a competitive edge in the real estate industry. Our services will hereafter be referred to as “content”.

A Mutual Agreement Between Enhanz and the Client

If we are designing content for you, we will create results to the highest standard possible, based on the materials that you provide. In a situation where you are unhappy with our content at any step in the process, you can request an amendment to the project, which can be arranged at our discretion. 

You agree to provide Enhanz with a thorough brief at the beginning of the project. This is compulsory to enable us to complete the content, to the highest of standard. 

Important Contractual Information 

Design or Content Creation

If we are designing content for you, we aim to deliver results you will love, based on the brief you provide us. You agree that any amendments that go beyond our agreement and original specification at the beginning of the project are unforeseen and therefore will incur an additional charge. This charge will be enforced to allow additional alterations to be made, aligning with your updated specification. 

Editing

Enhanz will work to edit the content, supplied by you, delivering results in accordance with the requests you have made at the beginning of the project. If you request additional alterations that do not fall within our agreement, additional charges may occur. In the unlikely instance where we cannot conclude a project for you due to unprecedented circumstances, we agree to refund any monies you have paid to Enhanz within a judicious time period.  

The Legalities 

Enhanz evolve your photographs in our transformative service. We cannot assure you that the content we deliver will not be regarded as deceptive or dishonest from another person(s) or company(s) viewpoint. We cannot take responsibility for this and will not be accountable to you or any third party for damages, including lost profits, lost savings or further related, consequential or special damages that occur as an upshot of the delivery of our labour. 

You agree that Enhanz are not aware of how the output data, text, or otherwise, is going to be used and we will not be held accountable to you or any third party for damages, including lost profits, lost savings or further related, consequential or special damages that occur as an upshot of how you have decided to use the output data.

If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the legitimacy and enforceability of any outstanding provisions.

Copyrights

You pledge assurance to us that any content, including text, graphics, photographs, designs, trademarks, or any other elements that you send to us for the project is either owned by you or permission has been granted for you to use.  

When you pay for a project, copyright is routinely assigned as follows:

The content that we return to you on completion of this project is owned by you. On completion, we will provide you with a copy of all relevant files. We recommend that you save these immediately. Enhanz are not required to back up or maintain any completed projects and we are not required to provide any native source files that were used to make your completed project. 

All content including text, photographs and any other data that was provided by you in the beginning of the project, is owned by you, unless stated otherwise. 

Enhanz are extremely proud of our projects and enjoy sharing these with other creators, clients and our target audience. You agree to allow us the right to display and link to images, both suppled and completed as part of our agreed project. This content can be shared publicly on social media, on our website, in email marketing, in print media and any other forms of traditional or digital media. 

To Conclude

In the unforeseen circumstance where one part of these terms and conditions becomes invalid, inacceptable or irrelevant, the outstanding parts remain in place. In this situation, we will promptly update our terms and conditions, if and how we see required. 

Enhanz are a client focused, innovative and modern organisation. Hence, we have created these terms and conditions to be read and understood by all. However, the unceremonious manner in which we deliver our terms and conditions does not reflect its dependably. The intentions are serious under (LEGAL COURT REFERENCE NEEDED). When a client begins a project with Enhanz, they are agreeing to the Terms and Conditions, stated in this document.
